Document Management Solutions
Your business
most likely requires individuals to share information, economically
and efficiently. Your clients may require a rapid response
to their business expectations. The problem is that
90% of a company's information still resides on paper.
To continue doing business in the future, your company
will need to develop cost effective solutions to meet these
challenges.
Over
the past decade, networking went from a new business opportunity
to a mature business where most companies have now established
their own local area network (LAN). This network provides
the infrastructure necessary to share information. Herein
lie the problem and the opportunity for your company.
Although networking has reached the mature stage, document
management is just at the beginning of its business cycle.
In a business environment where information is processed
at lightning speed and clients have high expectations,
an antiquated paper filing system
limits the whole process of effectively sharing information.

Federal Court System:
The United
States Federal Court system is converting to an electronic
filing system through the CM / ECF program (Case Management
/ Electronic Case Filing system), which is expected to be
fully functional by the end of 2003.
If a law firm wants to interface with the US Federal
Court system, they will need to file electronically using
the PDF file format.
HIPAA:
The federal
government under HIPAA (Health Insurance Portability and
Accountability Act of 1996) is pushing the healthcare
industry to convert patient records into electronic records.
Hospitals, clinics, physicians, and other health care providers
are actively seeking solutions to meet the new HIPAA rules
and regulations. See a sample "
Business
Associates Agreement."

Family
Educational Rights and Privacy Act (FERPA):
is a federal law that applies
to educational agencies
and institutions that receive federal funds under any
program administered by the Secretary of Education.
20 U.S.C. § 1232g; 34 C.F.R. Part 99.
Generally, FERPA prohibits the funding of an educational
agency or institution that has a policy or practice of
disclosing a student’s “education record” (or personally
identifiable information contained therein) without the
consent of the parent. When a student turns 18 years old
or attends a postsecondary institution at any age, the
rights under FERPA transfer from the parent to the
student (“eligible student”).
FERPA defines “education
records” as “those records, files, documents and other
materials which –
(i) contain information directly related to a student;
and
(ii) are maintained by an educational agency or
institution or by a person acting for such agency or
institution.” 20 U.S.C. §
1232g(a)(4)(A)(i) and (ii).
FERPA generally requires
prior written consent from the parent or eligible student before an
educational agency or institution may disclose
personally identifiable information from education
records to a third party. However, the law contains 16
exceptions to this general rule. Read more about FERPA.
